CHERNOBYL-EXPLORATION.COM Article 1 - Scope
In accordance with article R211.4 of the Tourism Code, these special conditions of sale are intended to inform Chernobyl Exploration customers before signing the contract, of information provided for in the aforementioned article.
In accordance with article L211.9 of the Tourism Code, this pre-contractual information will form an integral part of the contract and may only be modified within the framework of an agreement expressly agreed between the parties.
These special conditions of sale (SCOS) may be modified and updated by CHERNOBYL-EXPLORATION.COM at any time. The applicable SCOS are those in force at the time of registration.
These SCOS are communicated to the customer at the time of booking a service with SARL APPRENDRE AUTREMENT and can be viewed and downloaded from the website: www.chernobyl-exploration.com in the customer area of each customer or on request by email.
The reservation of one of the tourist services offered by CHERNOBYL-EXPLORATION implies the unconditional acceptance of the provisions of these SCOS.
Article 2 - Contrat formation
Any registration will only be definitively taken into account under the following conditions:
Internet orders, the Customer selects on the site the services he wishes to order, in the following ways:
- Registration on the website www.chernobyl-exploration.com, travel selection, validation of the participant (s), selection of place and date, online payment, receipt of registration and payment confirmation.
Orders by email, mail, fax:
- on the one hand, upon receipt of the completed, dated and signed registration form or validation of the registration form via our site by the online registration procedure subject to confirmation by Chernobyl-exploration taking into account the places available and a number of participants at least equal to 6.
- and on the other hand, of the reception of the payment in accordance with article 5 of these SCOS.
Any document other than these general conditions of sale and in particular catalogs, prospectuses, advertisements, notices, has only an informative and indicative value, not contractual.Article 3 - Retraction
The 14-day right of withdrawal does not apply to accommodation, transport, catering and leisure services (ticket offices, guided tours, etc.) which are provided on a date or at a period determined in application of the article L121-21-8, 12° of the French consumer code.
Article 4 – Prices and price revision
All prices are displayed in euros and include VAT at the rate in force on the date of the order.
Price increases are only possible if they are the direct consequence of a change in the price of passenger transport resulting from the cost of fuel or other sources of energy. Chernobyl-exploration will justify the revision of the prices to the customer on a durable medium, at the latest 20 days before the start of the service.
They include supervision by a professional photographer (English and French) or a guide (English) depending on the chosen formula. accommodation, catering (for trips and stays where this is stipulated). Unless otherwise stipulated in a description of a service confirmed in the contract, the following are not included in the price: personal expenses, insurance, drinks, international transport, local entry and / or exit taxes where applicable, visa fees, vaccination fees, options, tips, visits and excursions not included in the program and, where applicable, tourist tax. Prices do not include the supply of a camera and its accessories. You must have a camera to benefit from the services of the accompanying photographer if the Photo Travel package is chosen.Article 5 - Payment
Any registration is subject to the payment of the entire service or the payment of a deposit and a balance 45 days before the start of the service depending on the type of service purchased.
Payment is made:
- For a registration made less than 24 hours or the same day of the trip, payment is full and imperatively by credit card.
- For registrations made less than 21 days before the date of travel, the full price of the stay of more than 1 day must be paid 100%.
- For registrations more than 45 days before the date of the trip from 1 day to 5 days, a deposit of 30% of the price of the trip is mandatory. The balance of the price of the service must be paid, without reminder from CHERNOBYL-EXPLORATION, at the latest 45 days before the start of the service.
Any delay in the payment of the service may be considered as a cancellation for which the cancellation fees provided for in these SCOS will be applied.
Credit card payments are debited when the order is shipped. Credit card payments are debited when the order is shipped. It is the Customer's responsibility to check that this e-mail is received correctly and to check their SPAM. If the recipient's e-mail is not valid, Chernobyl-exploration cannot be held responsible for the non-recall.Article 6 - Modifications
6.1 Due to the Client
For trips of more than 2 days, a request for modification for an early departure or delayed return may be requested. In the event that there is an early departure, it is your responsibility to find the group on site without penalizing the participants of the trip as well as its smooth running. This date request must be made forty-five (45) days before the departure date, by e-mail.
Any additional cost of one of the elements of the services provided by Chernobyl-exploration is the responsibility of the applicant. Any modification of the package by the Customer less than 10 days before departure entails the payment of a lump sum of 75€ per person.
Any modification of the services by the customer on site cannot be reimbursed by Chernobyl-exploration (shortened stay for example), as well as any service not consumed. Cancellation fees may be charged, according to the scale set out in these SCOS .
6.2 Due to the company SARL LEARNING DIFFERENTLY
6.2.1 - Before leaving.
In accordance with article L211-13 of the French tourism code, CHERNOBYL-EXPLORATION may, before the start of the service, unilaterally modify the clauses of the contract other than the price in accordance with article L211-12 of the French tourism code, in the conditions and according to the methods provided for in article L211-13 of the French tourism code. The modification must be minor and Chernobyl-Exploration must inform the client in a clear, understandable and apparent manner on a durable way:
1. Proposed modifications and, if applicable, their impacts on the price of the service,
2. Reasonable time within which to communicate its decision to Chernobyl-Exploration,
3. Consequences of failure to respond within the set deadline,
4. If applicable, the other service offered, as well as its price.
When the modifications to the contract or the replacement service lead to a reduction in the quality of the trip or stay or in its cost, the customer is entitled to an appropriate price reduction.
If the contract is resolved and the client does not accept any other service, Chernobyl-Exploration reimburses all payments made by the client as soon as possible and in any event no later than fourteen days after the termination of the contract, without prejudice to compensation under article L 211-17 of the French tourism code.
Chernobyl-Exploration will give you the name of the photographer accompanying the trip for information. Chernobyl-Exploration reserves the right to change, without notice, accompanying photographer. No compensation may be due in this respect.
6.2.2 - After leaving.
When, after departure, one of the essential elements of the contract cannot be performed, Chernobyl-Exploration, unless duly justified as impossible, will offer the Client services in replacement of those which are not provided without additional cost to the Client. If the modifications are not accepted by the Customer, Chernobyl-exploration will provide the Customer with the transport tickets necessary for his return, without prejudice to the damages which the buyer could claim.
During the trip or stay, the program may undergo modifications or adjustments, depending on unforeseeable local events such as official travel, political cultural events or current weather conditions as well as transport or accommodation services, which will be provided under equivalent conditions, On certain dates, the trip stages may be reversed or shifted. However, all visits will be respected as far as possible. In this case, only managers are empowered to make the necessary decision(s). No compensation may be due in this respect.Article 7 - Cancellation
7.1 - Due to the Customer
In accordance with article L. 211-14, I of the French Tourism Code, the customer may terminate the contract at any time before the start of the service, subject to respecting the following procedure and conditions of reimbursement:
Any cancellation notification shall be made by email to Chernobyl-exploration via the contact page on the website. The date of reception of your e-mail will be taken into account for the calculation of the cancellation fees. Only the initial subscriber is entitled to cancel a trip.
The amount received by Chernobyl-Exploration, as defined in these SCOS, will be automatically acquired and cannot give rise to any reimbursement.
Cancellation fees of 270 € (Two hundred and sixty euros) will be due.
A customer who could not participate in his trip, failing to present the required documents, mentioned on the order form given to him, could not claim any refund.
7.2 - Due to CHERNOBYL-EXPLORATION
In accordance with article L. 211-14, III of the French Tourism Code, CHERNOBYL-EXPLORATION may terminate the contract and fully reimburse the customer for the payments made, without there being any need for additional compensation, if:
1. The number of people registered for the tourist service or the package is less than the minimum number indicated in the contract and that CHERNOBYL-EXPLORATION notifies the termination of the contract to the customer within the period fixed by the contract, and at the latest:
- 20 days before the start of the service if its duration exceeds 6 days,
- 7 days before the start of the service in which its duration is 2 to 6 days,
- 48 hours before the start of the service in which its duration is less than 2 days.
Article 8 - Force majeure
The customer and CHERNOBYL-EXPLORATION have the right to terminate the contract before the start of the service without paying resolution costs when a cancellation or modification is imposed by force majeure, such as - for information only but nonlimiting the occurrence of a natural cataclysm, an armed conflict, a labor dispute, an imperative injunction from the public authorities, a disruption of transport, an operating accident - meaning the occurrence of an unforeseeable event, independent of the will and which it is impossible to overcome despite the efforts to resist it.
The party invoking force majeure related to an aforementioned event must notify the other party by all means in a clear, understandable and apparent manner on a durable medium as soon as possible. The parties may consult together, as far as possible before the service, to examine in good faith whether the contract should continue or end. The party injured by the non-performance of the obligation prevented by the event in question will have the right to cancel the service without notice. Pursuant to article 1148 of the French Civil Code will it take place at no damage and interest.Article 9 – Organization of the stay and Services
Trips offered are based on twin bed room. The single room option can be offered with additional price only in Kiev in the exclusion zone of Chernobyl where single rooms are not available. As we won't ask male and female they don't know each other to share the same room, it might happen we need to ask one male or female to use alone one twin bed room. This case can happen to the latest registered person of the trip when full twin bed room occupation can't be ensured. We always do our best to find a solution and offer this option to another person in the group, but in the case where a person in the group wishes this option, we are obliged to offer it automatically, with a commercial discount.
Length of stay
Depending on the flight schedule and the airline, the day of arrival in France may be the day of local departure, in which case it is agreed that the program will have been fulfilled. On some airlines, flights may be night flights. Moreover, a carrier may have to modify the conditions of a departure or a return, for reasons of passenger safety, especially during periods of heavy traffic, or due to strikes either by its staff or staff terminals, or due to weather conditions in which case Chernobyl Exploration cannot be held liable. Chernobyl-Exploration will not bear any costs that may arise under these conditions.
Time and meeting points are communicated 15 days at the latest before the date of departure. Customers are responsible for their transportation to the meeting point and their return.Article 10 - Sanitary and administrative conditions
Customer must ensure that he is in good condition with the health formalities necessary for the completion of the trip and pregnant women to learn about the travel conditions according to the airlines.
Chrnobyl-Exploration cannot replace the individual responsibility of each of the participants. They must comply with local police, customs and health regulations and formalities at all times during the trip.
Before registering to undertake his trip, the participant must check, according to his personal situation and his nationality, that he is in possession of the valid passport, which will be used to carry out the planned trip as well as any other document (s) (visa, family record book, authorization to leave the country, etc.) required and in accordance with the requirements for transiting and or entering the country (ies) of the journey.
Chrnobyl-Exploration provides information on customs and health formalities for French nationals in its travel offer. People of other nationalities must get inform by their own before registering and making their journey about the administrative formalities (visas ...) and health formalities (vaccines ...) required in particular from embassies and consulates competent.
If you have been prescribed medical treatment, make sure you can follow it during the trip.
Customer who could not participate in his trip, failing to present the required documents mentioned on the registration form or travel book and various documents such as visa formalities which he was given, could not claim any refund.Article 11 - Air services
We generally do not offer flights departing from France or returning to France, but we can inform and guide you on the places and times of departure and return without Chernobyl-Exploration being intermediary or offering a tied sale with air transport. However, they can be offered to you as an option as part of the package offered by Chernobyl-Exploration; a free estimate can be communicated to you on request. These flights are operated by different carriers who retain their own responsibilities towards travelers. Carrier's liability is limited by the terms and conditions set out in the transport contract appearing on the passenger's ticket, and in particular by the provisions resulting from the Warsaw International Convention or the Montreal Convention.
All consequences resulting from the loss, theft, modification or cancellation of tickets will be the sole responsibility of the customer.Article 12 - Group size – Infants
Unless otherwise indicated, the maximum group size for our trips is 6 to 8 people. We can exceptionally be forced to cancel a departure if the minimum number of participants is not reached which you will find on the brochures downloadable on the site www.chernobyl-exploration.com. This decision will be communicated to you no later than 21 days before the departure date initially scheduled. Alternative solution may then be offered to you. In the case that the alternatives offered do not suit you, your payments will be returned to you in full, without other compensation. All costs incurred by you remain at your expense.
Chernobyl-Exploration agrees to register underage travelers accompanied by a person having parental authority or a third person with permission to leave the country. For minors, you should make sure that you are in possession of the documents necessary for the minor accompanying you (family record book and national identity card or passport and, if applicable, authorization to leave the territory).
Chernobyl-Exploration cannot be held responsible if, despite this prohibition, an unaccompanied minor is registered, without his knowledge, on one of his trips.Article 13 - Insurance
When booking, Chernobyl-Exploration offers you to take out comprehensive or cancellation insurance with Europe Assistance. We invite you to check that you do not otherwise benefit from these guarantees. The general and specific conditions of these insurances are available on the website https://www.europ-assistance.fr/ or on request. We invite you to read them carefully. If you wish to take out this insurance once your registration has been confirmed by SARL APPRENDRE AUTREMENT, contact us by email or by phone on +339.83.975.797 or +336.50.431.201.
In case of claim, before or during the trip, it is your responsibility to contact Présence Assurance tourisme or your own insurance directly in order to initiate the appropriate procedure.Article 14 - Assignment of the contract
In accordance with articles L211-11 and R211-7 of the French tourism code, the customer may, as long as the contract has produced no effect, at the latest 7 days before the start of the service and by any means enabling it to be obtained an acknowledgment of receipt, inform Chernobyl-Exploration of the assignment of the contract to another person who meets all the conditions applicable to this contract and who fulfills the same conditions as the initial client to perform the service.
In the event of an assignment, the client and the assignee will be jointly and severally liable for the payment of the balance of the price as well as any fees, charges or other additional costs occasioned by this assignment. Chernobyl-Exploration will inform of the real costs of the transfer, which must not be unreasonable or exceed the cost actually borne by the SARL APPRENDRE AUTREMENT due to the transfer of the contract.CANCELLATION FEES PER PERSON
1 day stay Article 15 – Duty
Chernobyl-Exploration is the sole interlocutor of the client and answers to him for the performance of the services ordered and the obligations arising from these specific conditions of sale. It is fully responsible for the execution of the services provided for in the contract, whether these services are performed by itself or by other service providers, and is required to provide assistance to customers in difficulty.
Chernobyl-Exploration cannot be held responsible for booking errors which are attributable to the customer or which are caused by exceptional and unavoidable circumstances, for the total or partial non-performance of the services ordered in a case of force majeure as defined in article 8 of the present SCOS, to the fact of a third party, to a bad performance of its obligations by the customer, or in the event of fault of this last.
Customer informs Chernobyl-Exploration, as soon as possible given the circumstances of the case, of any non-compliance found during the performance of a travel service included in the contract. Chernobyl-Exploration cannot be held liable for damages of any kind that may result from a temporary unavailability of the site or from an interruption of the customer's connection during the registration, reservation or payment process.
If one of the travel services is not performed in accordance with the contract, Chernobyl-Exploration remedies the non-compliance, unless this is impossible or entails disproportionate costs, taking into account the importance of the non-compliance and the value of the travel services concerned. If Chernobyl-Exploration does not remedy the non-compliance within the reasonable time fixed by the client, the client can remedy it himself and claim reimbursement of the necessary expenses.Article 16 - Protection of personal data
Chernobyl-Exploration is likely to collect personal data necessary for the computer processing of your registration, its follow-up, the sending of newsletters, promotions and solicitations or as part of quality surveys (via emails, messages SMS, phone calls and mail). In accordance with the law, after express authorization from the client, SARL APPRENDRE AUTREMENT may photograph and / or film the client, store and publicly disseminate its image for professional and non-commercial purposes only, in the context of promoting its activities.Article 18 - Photos / Illustrations
Photos, maps and illustrations contained in the brochures and / or the website are illustrative and are not contractual.Article 19 - Archiving the contract
Any contract concluded with the customer corresponding to an order of an amount greater than €120 including tax will be archived by Chernobyl-Exploration for a period of 10 years in accordance with articles L213-1, R213-1 and R213-2 of the code of the consumption in France and a copy can be produced at the customer's request.Article 20 - Applicable law, complaints and litigations
These special conditions of sale are subject to French law.
Any complaint relating to the services provided by Chernobyl-Exploration must be addressed, within 20 days from the end of the service provided, by any means accompanied by all the supporting documents, to Chernobyl-Exploration.
For any dispute that may arise between the parties regarding the interpretation and execution of these, the parties agree before any proceeding to find an amicable agreement. After entering Chernobyl-Exploration and failing a satisfactory response within 60 days or if the response received is not satisfactory, the client can appeal to the Mediator of Tourism and Travel (www.mtv. Travel).
If the sale is made online, the customer has the option of using the platform available on the website https://webgate.ec.europa.eu/odr to settle his dispute.
Any dispute that could not be settled amicably will fall exclusively to the Tribunal de Grande Instance of Montpellier (France) for a legal person, and in the case of a natural person, jurisdiction is assigned to the competent court in accordance with article L .141-5 of the Consumer Code in France.
